TERMS & CONDITIONS

1. You should read these terms and conditions carefully before submit an order to us. We are Zeemou Zeng Ltd, a company registered in England with Company Number 10877042, registered office at 17 Hanover Square, Mayfair, London, W1S 1BN, U.K. You are welcome to place your orders online via our website: zeemouzeng.com (the “Site”) at any time. We can be reached by email at info@zeemouzeng.com, from Monday to Friday at 9:00AM-5:00PM.

2.We may vary these Terms from time to time; therefore you should check them before you make a purchase.

3. Any use of this Site including placing any orders (“Order”) for goods as set out in the order (“Goods”) through this Siteconstitutes an agreement to be bound by these Terms which shall override any other terms and conditions. 

GOVERNING LAW & JURISDICTION

4. Any contracts or agreements entered into between you and us via this Site shall be governed and construed according to the laws of England. 

5. Any disputes arising from and/or in connection with the use of and purchases made via this Site shall be subject to the exclusive jurisdiction of the English courts.

ONLINE PURCHASE

6. We have taken care in presenting the products on our Site as accurately as possible. The pictures you see will depend on your monitor’s display and colour capability; the pictures only provide an approximate images of the Goods, in particular: 

6.1.     whenever metal weights or carat weights are quoted, these are the average for all pieces in that design;

6.2.     where we offer rings in multiple sizes, the weight will be the average across all pieces in all sizes;

6.3.     where an item is hand-made or hand-crafted, the variance between the average and any one piece may increase;

6.4.     throughout the jewellery industry, many gemstones undergo some form of treatment to enhance their appearance or durability. You should therefore assume that any gemstones in the jewellery you purchase from us are treated; 

6.5.     as some gems are sourced which have already been faceted, we cannot always verify and/or guarantee the reported origin.

ACCEPTANCE

7. Your order will be accepted by us only when: 

7.1.     You receive out email you that your order has been accept it; or

7.2.     If you have not provided us with your email address, when we ship your order, at which point a contract will come into existence between you and us. 

8. A receipt for an order by our Customer Service Team or via our Site or assignment of an order number to your order does not constitute our acceptance of an order.

9. Your order number is given to you when we receive your order; it does not constitute our acceptance of your order but merely helps us to identify your order when you contact us about your order. 

10. If we are unable to accept your order for whatever reason, we will inform you of this either by telephone or in writing; we will not charge you for the Goods. 

THE GOODS

11. We may change the Goods to reflect changes in relevant laws and regulatory requirement, or to implement minor technical adjustments and improvements. These changes will not affect your use of the Goods.

12. As we have informed you in the description of the Goods on our Site, we may after accepting your order make material changes to the Goods or to these terms; but if we do so, we will notify you and you may then contact us to end the contract before the changes take effect and get a refund for any Goods paid for but not received.

13. We warrant that the Goods on delivery shall: 

13.1    conform with their description subject to certain qualification at clauses 11 and 14 as set out in these terms and conditions;

13.2    be of satisfactory quality;

13.3    be fit for the purpose we say;

13.4    be free from material defects in design, material and workmanship for a period of two (2) years from the date of your purchase (the “Guarantee Period”); and

13.5    comply with all applicable statutory and regulatory requirements for selling the Goods in the United Kingdom; and

13.6    warranty exclusions: this warranty does not apply to any defect in the Goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, including the use of the Goods in a way that we do not recommend, your failure to follow our instructions or any alteration or repair you carry out without our prior written approval.

14. The images of the products on our Siteare for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your products may vary slightly from those images. Accordingly, we shall not be liable for any discrepancy in the photographs or graphical representations of our products displayed on the Site. 

15. If you have a specific question regarding availability, sizing, or anything else, please contact our team at info@zeemouzeng.com.

16. We send by email confirmation of all orders and despatches. We also advise that you provide us with your telephone and/or mobile numbers in case we might need to contact you more urgently.

17. You should ensure that the email address and address you provide to us are accurate and up to date. 

ENGRAVING

18. We offer engraving to help you maintain the moment of an emotion, occasion or memory which you hold dear through our unique, symbolic and personalised service.

19. The engraving of your choice is undergone with respect to the technical and aesthetic specifications of the piece of the jewellery. The standard engraving technique uses technology to create characters which are then engraved onto your chosen piece. Selected pieces ordered via our Site may be engraved with up to three uppercase initials or characters. You will be able to preview your engraving before purchase via our Customer Services team.

20. The price for engraving service is:

Standard engraving:                                                    £20 for three characters;

A pair of cufflinks engraving:                                       £40;

Additional letters/characters (if can be engraved):    £1 per letter/character.

21. The following cannot be engraved:

Inappropriate language;

Offensive symbols;

Languages other than English, Arabic and Chinese;

Fonts other than Simple, Block, Deco, Script, Chinese fonts.

22. Please allow an additional 5 working days for delivery of standard engraved pieces you purchase.

23. We are not able to accept any personalised or engraved items for refund or exchange.

ADJUSTMENT

24. A careful adjustment to creation for your order ensures that it fits well and with the comfort. We apply technical expertise to finely adjust your chosen piece of jewellery. The adjustment skilfully shapes the metal of a ring, modify the length of a chain, adapt the post or clip mechanism of an earring to achieve fitness and comfort.

25. This service is always undergone with respect to the original technical and aesthetic specifications of the piece.

26. The service is complimentary only when the adjustment is made within 3 months of your order.

27. After the three months, we apply a charge in the range of £60 to £180 inclusive of VAT.

28. You should contact us for further details if you require this service.

DELEVERY

29. Your order will only be ready for delivery upon successful receipt of full payment of the price for the Goods.

30. We deliver within the UK. We also ship to Europe and rest of the world. We charge for one delivery per order, regardless of the quantity of Goods you order. Deliveries to multiple addresses require multiple orders and multiple delivery charges. Our delivery charges are as follow:

31. If an item is in stock and available for shipping, it will be processed for delivery within 1-2 working days. For UK Standard Insured Delivery, it usually takes around 3 working days to arrive once the item has been sent for delivery; for Europe Priority Insured Delivery, it usually takes 3-5 working days; for Rest of the World Priority Insured Delivery, it usually takes 5 working days or longer.

32. If an item is not in stock, it will be made to order and the item will usually take 5-8 weeks to become available for delivery. Our representative will contact you with an estimated delivery date. If an item is made sooner than expected, it will be arranged for delivery immediately and you will be notified.

33. For international shipments outside the European Union, all import duties, sales taxes and/or other import costs as incurred at the point of entry into the country of destination are the customer’s sole responsibility.

34. Orders placed during non-working days and holiday seasons or when experience a high volume of orders can take longer than the allotted time window. Our representative will notify you if the production time is longer than usual.

35.  You should be aware that delivery period may vary depending on various factors which are often beyond our control. We are not responsible for delays in the delivering or supplying the Goods if such delayed is caused by an event outside our control. We will contact you as soon as possible to let you know that there will be a delay. We will not be liable for any delays caused by the event or consequential impact you face; but you may contact us to end the contract and receive a refund for the Goods you have paid for but not received.

37. We reserve the right to refuse sales to and/or the right to cancel orders placed by a customer in violation of this Site’s terms and conditions or as otherwise determined by us.

38. We require your signature confirmation upon delivery of the Goods for all our orders. 

TITLE & RISK

39. The Goods becomes your responsibility from the time of delivery through to the time when the Goods are delivered at your delivery address.

40. Ownership of the Goods only passes to you when we receive payment in full of all amounts due for the Goods including delivery charges.

PRICE & PAYMENT

41. The price of the Goods includes VAT for orders made within the EU. VAT will be indicated on the confirmation when you place the orders. The price of the Goods (including VAT) will be the price indicated to you when you place your order. We take reasonable care to ensure that the price of the Goods advised is correct.  

42. If we discover an error in the price of the Goods you order, where the Good’s correct price on your order date is less than the stated price on your order date, we will charge the lower amount. If the Good’s correct price on your order date is higher than the price given to you, we will contact you for your instructions before we decide to accept your order. If we accept and process your order where a pricing error is obvious and could reasonably have been recognised by you as a mispricing, we may end the contract, require the return of any Goods supplied to you and refund you any amount you have paid.

43. Payment for the Goods are due and taken once your order for the Goods are accepted. At this point you will be charged for the payment. 

44. Bank cards issued outside the EU may be subject to cross-border transaction fees. All credit or debit card orders may incur fees if placed in a currency other than that for which the card is issued. These charges and any similar ones with alternate payment methods, which are outside of our control. All these fees and charges must be borne by you and paid by you directly to your card issuer.

RETURN & EXCAHNGE

45. Goods returned to us must be contained in our original “ZEEMOU ZENG” packaging and accompanied by the appropriate slip. You may reinforce the packaging with additional packaging for safety. 

46. If we receive the Goods returned by you as new, unworn and in original packaging with original authenticity card and adequate outer packaging for transit protection for the Goods, and without removal of the attached identification tag and hygiene seal and without alteration such as resizing and engraving,we will process your refund within a maximum of 30 days of receiving your returned Goods in the United Kingdom. 

47. We cannot accept returns of correctly engraved Goods which show signs of wear or use. All of our Goods are checked and packaged by hand in London, UK in order to maintain our standard. Pierced jewellery such as earrings for hygiene and safety reasons will not be refunded or exchanged. 

48. We do not give cash or credit card refund unless you cancel your order within 14 days (i.e. the cooling-off period) pursuant to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and you have complied with our above requirements; we will arrange an exchange or issue a merchandise credit. 

49. All costs incurred for shipping returned Goods are the sole responsibility of you, the customer, including duty reclaims on returned Goods, although we will endeavour to assist you with required paperwork.

50. If the Goods are returned during the Guarantee Period, we will repair or replace the defective Goods or part of the defective Goods free of charge within a reasonable time after we receive the return, subject to the right charge having been paid for shipping costs. Upon expiration of the Guarantee Period, any repair is subject to a service charge. You should contract us for further details.  

LOST PACKAGE 

51. We do not accept responsibility for packages or parcels which are lost in transit.

REPAIR

52. For any repair enquiry, please contact us and include your name, address, order number and repair issue in your enquiry.

53. We provide a guarantee for a period of 12 months from the date of your purchase order.

54. We only accept repairs for items purchased on our Site. 

55. Repairs for items purchased at one of our retailers must be returned through the original point of purchase. Proof of purchase is required to validate the guarantee. 

56. Our guarantee covers manufacturing and material defects for current branded products only. Our guarantee only covers damage that are not caused by accident, inappropriate use or normal wear and tear. Depending on the damage, the item will either be repaired or replaced with another item of equal value. 

57. All items for repairs outside our guarantee period will incur an additional charge. 

RIGHT TO CANCEL

58. Under the Consumer Contracts Regulations 2013, you have a legal right to change your mind within 14 calendar days from the day after you (or someone you nominate to) receive the Goods. This period is called the cooling-off period.  

59. If the Goods returned to us do not comply with our requirements in clauses 34-38, we will not refund you in full amount paid but subject to certain conditions deductions and costs for the return of any Goods.

INDEMNITY

60. You agree to indemnify each of us, our affiliates employees officers directors and agents from any claim losses damages liabilities costs or demands including reasonable professional advisers’ fees arising out of or relating to your breach of any of these terms and conditions. 

61. This indemnity shall not apply to any claim losses damages liabilities costs or demands resulting from our negligence or wilful misconduct. 

62. This indemnity shall continue to endure notwithstanding prior fulfilment of the order or other termination thereof. 

DATA COLLECTION & GDPR

63. We collect personal information including but not limited to email address, physical contract information, credit/debit card information, bank details based on your activities on our Site, delivery billing and other information you provide to purchase/deliver an item, correspondence sent to us, computer log-in data, statistics on page views, traffic to and from the Site, other information including IP address, Browser, Operating System, Domain Name and Time and other standard web log information. 

64. We use these information to fulfil our contractual obligations and legitimate interests. In circumstances we will also seek your consent to our usage of your personal information.

65. We may share personal information with other organisations such as service providers under contract who help our business operations such as order fulfilment, shipping, bill collection and fraud investigations, etc. 

66. We may also share personal information with law enforcement and other government officials in response to a verified request relating to a criminal investigation or alleged illegal activity.

67. We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone's rights, property or safety.

68. We will never lease, distribute or sell your personal information to third parties unless the law requires us to. Any personal information we hold about you is stored and processed under our data protection policy, in line with the Data Protection Legislation.

69. We will not transfer your personal information outside the EEA without your consent.

70. You have the right to request a copy of the information that we hold about you. You can access the personal information we hold of you by writing to us at our address or by email.

MISCELLANEOUS

72. This contract is between you and us. This contract does not give rise to any rights of any third parties under the Contract (Rights of Third Parties) Act 1999 to enforce any terms of this contract.

73. You cannot transfer your rights and/or obligations under these Terms to any other party. 

74. Each of the paragraphs of these Terms operates separately. If any of these Terms is decided by the English court as unenforceable or unlawful, the remaining paragraphs of the Terms will remain in full force and effect. 

COPYRIGHT TRADE MARK AND CONTENT ON THIS SITE

75. We are the owners of the copyright of this Site and all materials on this Site including content design text graphics and photographs.

76.  You may download and print content from this Site for media related purposes or for your own personal use only. This is subject to the material being reproduced accurately and not being used in a derogatory manner or in a misleading context. 

77. Where this material is reproduced, published, broadcast or otherwise issued to others the source and copyright status must be acknowledged. The permission to reproduce our press releases does not extend to any material on this Site which is identified as being the copyright of a third party. 

78. No right, title or interest in any downloaded materials or software is transferred to you by such downloading. You may not make any other use of material on this Site (including reproductions, publication, alteration, distribution, broadcast or any other exploitation except as above) without our written permission.

 

DISCLAIMERS

79. This Site does not make any warranties or representations of any kind with respect to this Site or its contents or about the accuracy or completeness of the information contained on this Site. We disclaims all such representations or warranties. 

80. Neither the Company nor any of its directors, employees or agents will be liable for damages arising out of or in connection with the use of this Site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory direct indirect or consequential damages, loss of data, income or profit, loss or damage to property and claims of third parties.

81. We not exclude any liability for death or personal injury resulting from its negligence or the negligence of its directors, employees or agents.

82. We cannot be responsible for any losses you may incur in transmitting information to us by internet link or by e-mail. Any such loss shall not be borne either wholly or partly by us, and shall be entirely your responsibility.
